1. About Eternal+

Eternal+ is an AI companion and character-driven roleplay platform.

The Service allows users to interact with AI characters, explore fictional scenarios, and engage in ongoing AI-generated conversations.

Some features may be available without an account, while other features may require registration, sign-in, or a paid plan.

The Service may include adult-oriented fictional roleplay and an Unfiltered mode or similar functionality intended for adult users.

Eternal+ is not a human communication service, professional advisory service, or substitute for real-world professional assistance.

2. Acceptance of These Terms

By accessing or using Eternal+, you confirm that:

• you have read and understood these Terms;
• you agree to comply with these Terms;
• you meet the eligibility requirements described below;
• your use of the Service is lawful in your jurisdiction.

Your use of Eternal+ is also subject to our Privacy Policy and Community Guidelines.

If you do not agree to these Terms, the Privacy Policy, or the Community Guidelines, you should stop using Eternal+.

3. Adults Only and Eligibility

Eternal+ is intended exclusively for adults.

You must be at least 18 years old, or the age of legal majority in your jurisdiction if that age is higher, to use the Service.

By using Eternal+, you represent and warrant that:

• you satisfy the applicable age requirement;
• you are legally capable of entering into these Terms;
• you are legally permitted to access adult-oriented AI roleplay services where you live.

You must not access or use Eternal+ if you are under the applicable age requirement.

You are responsible for ensuring that your use of Eternal+ complies with the laws and regulations that apply to you.

4. Accounts

Certain features of Eternal+ may require an account.

You may be able to create or access an account through supported authentication methods.

You are responsible for:

• providing accurate account information;
• maintaining the security of your account;
• protecting your login credentials;
• activity that occurs through your account.

You must not:

• access another person's account without authorization;
• sell, transfer, or misuse an account;
• use another person's credentials without permission;
• create accounts for fraudulent or abusive purposes;
• attempt to avoid a suspension or restriction by creating additional accounts.

5. AI Companions and Fictional Content

Eternal+ uses artificial intelligence to generate conversations, character responses, scenarios, and related content.

AI-generated content is fictional and may be:

• inaccurate;
• inconsistent;
• incomplete;
• unexpected;
• offensive;
• unsuitable;
• factually incorrect.

AI characters are not real people.

They do not possess consciousness, emotions, intentions, personal beliefs, professional qualifications, or independent agency.

Statements made by AI characters should not be treated as factual representations about real people or real-world events.

You should not rely on Eternal+ for:

• medical advice;
• legal advice;
• financial advice;
• emergency assistance;
• mental health diagnosis;
• professional decision-making.

If you require professional assistance, you should consult an appropriately qualified professional.

6. Adult and Unfiltered Roleplay

Eternal+ may offer adult-oriented fictional roleplay, including an Unfiltered mode or similar features.

“Unfiltered” does not mean that all content or conduct is permitted.

Use of Unfiltered or adult-oriented features remains subject to:

• these Terms;
• our Community Guidelines;
• applicable law;
• technical limitations;
• safety requirements;
• restrictions imposed by underlying service providers or AI models where applicable.

We may restrict, refuse, interrupt, or remove content or access where reasonably necessary to enforce these rules.

7. Relationship to the Privacy Policy and Community Guidelines

These Terms govern your use of Eternal+.

Our Privacy Policy explains how information is collected, used, stored, and processed in connection with the Service.

Our Community Guidelines describe the content and conduct that are permitted or prohibited on Eternal+.

The Terms, Privacy Policy, and Community Guidelines should be read together.

If your use of Eternal+ violates the Community Guidelines, it may also result in action under these Terms.

8. User Content and Conversations

When using Eternal+, you may provide:

• prompts;
• messages;
• instructions;
• preferences;
• conversation content;
• feedback;
• other information submitted through the Service.

Together, these are referred to as “User Content.”

You retain any rights you may have in your User Content.

You grant us a limited right to process User Content as reasonably necessary to:

• provide the Service;
• generate AI responses;
• maintain conversations;
• operate account features;
• prevent abuse;
• maintain security;
• troubleshoot technical issues;
• comply with applicable legal obligations.

This permission does not transfer ownership of your User Content to us.

Depending on how you use Eternal+, conversation information may be associated with your account or stored through browser-based or local storage mechanisms.

You are responsible for the content you submit.

You should not submit confidential, highly sensitive, or legally protected information unless you are comfortable with that information being processed as part of the Service.

9. Characters and Character Content

Eternal+ may provide fictional characters, character descriptions, personalities, scenarios, images, tags, and related materials.

Characters may be created or configured by Eternal+ and may incorporate AI-generated elements.

Character behavior may vary based on:

• conversation context;
• previous messages;
• model behavior;
• product settings;
• technical conditions;
• safety requirements.

We do not guarantee that a character will respond identically or behave consistently across every conversation.

Characters available through Eternal+ are intended for fictional entertainment and roleplay.

You must not use the Service to deceptively represent that an AI character is a real person.

10. Prohibited Content

You must not use Eternal+ to request, create, promote, distribute, or facilitate content involving:

• sexual content involving minors;
• sexualized depictions of minors;
• minor-coded sexual characters or scenarios;
• child sexual exploitation or abuse;
• grooming or sexual exploitation of minors;
• human trafficking or sexual exploitation;
• illegal sexual content;
• non-consensual sexual content involving real people;
• sexual abuse or exploitation involving real people;
• serious threats of violence against real people;
• stalking, coercion, or targeted harassment;
• fraudulent or deceptive activity;
• content intended to facilitate serious criminal activity;
• unlawful exploitation of another person's identity, image, or likeness.

Additional restrictions may be described in our Community Guidelines.

11. Restrictions on Use

You must not misuse the Service.

You must not:

• attempt to gain unauthorized access to Eternal+ systems, accounts, or infrastructure;
• interfere with or disrupt the operation of the Service;
• introduce malware, malicious code, or harmful software;
• attempt to bypass technical restrictions, usage limits, or account restrictions;
• use automated tools to scrape or extract substantial portions of the Service without authorization;
• reverse engineer, decompile, or attempt to obtain proprietary source code except where such restriction is prohibited by law;
• copy or commercially reproduce substantial portions of the Service without authorization;
• resell, sublicense, or commercially exploit access to Eternal+ without permission;
• use the Service to send spam or conduct abusive automated activity;
• impersonate another person in a deceptive, harmful, or unlawful manner;
• use Eternal+ in violation of applicable law;
• attempt to evade enforcement measures imposed under these Terms or the Community Guidelines.

12. Free and Premium Plans

Eternal+ may offer Free and Premium plans.

Plan features may differ in areas such as:

• message allowances;
• access to particular AI models;
• premium features;
• usage limits;
• product functionality;
• service priority.

The current features and limits associated with each plan are displayed on the Pricing page or within the Service.

We may introduce, remove, modify, or replace plans and features over time.

Changes affecting paid users will be handled in accordance with applicable law and the terms presented at the time of purchase.

13. Message Limits and Usage

Eternal+ may impose message limits, generation limits, or other usage limits.

Your available usage may depend on:

• your plan;
• your account status;
• the feature being used;
• applicable product limits.

Where message allowances reset periodically, the applicable reset information may be displayed in your account.

Certain actions may count toward your usage allowance when they require AI generation or processing.

We may adjust usage rules where reasonably necessary to:

• prevent abuse;
• maintain service stability;
• manage infrastructure costs;
• introduce new plans or features.

We do not guarantee unlimited access to any AI model or feature unless expressly stated.

14. Payments and Billing

Paid Eternal+ plans may be purchased through a third-party payment provider, currently Creem.

When making a purchase, you may provide payment and billing information directly to the payment provider.

Eternal+ does not need to receive or store your full payment card number in order to process purchases through the payment provider.

Before completing a purchase, you should review:

• the price;
• billing frequency, if applicable;
• plan features;
• usage limits;
• other terms shown during checkout.

Payments may also be subject to the payment provider's own terms and privacy practices.

You are responsible for ensuring that the payment information you provide is accurate and authorized.

15. Subscription Renewal and Cancellation

Some paid plans may be offered as recurring subscriptions.

Where a plan automatically renews, the applicable renewal terms, billing period, and price will be presented during checkout or through the applicable payment flow.

If cancellation functionality is available through your Eternal+ account or payment provider, you may use that functionality to prevent future renewal.

Cancellation of a recurring subscription does not necessarily end access immediately.

Depending on the plan terms shown at purchase, paid access may continue until the end of the current billing period.

If a paid plan expires or is canceled, your account may return to a Free plan or another available level of access.

The specific subscription terms presented during checkout control over general descriptions in these Terms where there is a conflict.

16. Refunds

Refund eligibility may depend on:

• the circumstances of the transaction;
• the payment provider;
• the product or plan purchased;
• applicable law;
• any refund terms presented during checkout.

We do not guarantee that all payments are refundable.

Nothing in these Terms limits any refund rights or consumer protections that cannot legally be excluded.

If you believe a billing error has occurred or have a question about a payment, please contact us.

17. Third-Party Services

Eternal+ may rely on third-party services in order to operate.

These may include:

• AI model providers;
• hosting providers;
• database providers;
• authentication providers;
• payment processors;
• infrastructure or security services;
• analytics or operational tools.

Certain features may depend on the availability or operation of these third-party services.

Third-party services may be governed by their own terms and privacy policies.

We are not responsible for third-party services that are outside our reasonable control.

18. Service Availability and Changes

We aim to keep Eternal+ available and functional, but we do not guarantee uninterrupted or error-free operation.

The Service may occasionally be unavailable because of:

• maintenance;
• infrastructure failures;
• network problems;
• third-party outages;
• model availability;
• security incidents;
• product updates;
• technical errors;
• circumstances beyond our reasonable control.

Eternal+ is an evolving product.

We may add, modify, replace, suspend, or discontinue:

• characters;
• AI models;
• features;
• plans;
• message limits;
• interfaces;
• pricing;
• other parts of the Service.

Where required by applicable law, we will provide appropriate notice of material changes affecting paid services.

19. Intellectual Property

Eternal+ and its associated platform materials may include:

• software;
• interfaces;
• branding;
• designs;
• text;
• graphics;
• character materials;
• visual elements;
• underlying technology;
• other original content.

These materials may be protected by copyright, trademark, and other intellectual property laws.

Except as expressly permitted, you may not:

• reproduce substantial parts of the Service;
• distribute or resell Eternal+ materials;
• commercially exploit Eternal+ content without authorization;
• remove proprietary notices;
• use Eternal+ branding in a misleading way;
• falsely suggest affiliation with or endorsement by Eternal+.

Nothing in these Terms transfers ownership of Eternal+'s intellectual property to you.

20. Feedback

You may choose to provide feedback, ideas, suggestions, or recommendations about Eternal+.

If you do so, you allow us to use that feedback to improve, develop, or operate the Service without an obligation to compensate you.

This does not transfer ownership of unrelated User Content, private conversations, or other materials that you submit through the Service.

21. Enforcement, Suspension and Termination

We may restrict, suspend, or terminate access to Eternal+ where we reasonably believe that:

• you violated these Terms;
• you violated the Community Guidelines;
• your activity creates a security risk;
• your activity exposes other users or the Service to harm;
• your activity appears fraudulent or abusive;
• you attempted to circumvent enforcement measures;
• we are required to take action under applicable law;
• continued access creates serious operational or legal risk.

Depending on the circumstances, enforcement may include:

• content restriction;
• feature restriction;
• temporary suspension;
• permanent account termination.

Serious or repeated violations may result in stronger enforcement.

You may stop using Eternal+ at any time.

22. Legal Requests and Safety

We may preserve, review, disclose, restrict, or report information where reasonably necessary to:

• comply with applicable law;
• respond to valid legal process;
• enforce these Terms or the Community Guidelines;
• protect the security of Eternal+;
• investigate suspected fraud or abuse;
• protect the rights or safety of users or others;
• respond to serious or imminent threats.

Where content may involve unlawful exploitation or abuse of minors, human trafficking, or other serious unlawful activity, we may take appropriate action as required or permitted by applicable law.

Nothing in this section means that Eternal+ actively monitors every conversation or item of content.

23. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Eternal+ is provided on an “as is” and “as available” basis.

We do not guarantee that:

• the Service will always be available;
• the Service will be free of errors;
• every feature will operate without interruption;
• AI responses will be accurate;
• AI responses will be appropriate;
• characters will behave consistently;
• generated content will meet your expectations;
• defects will always be corrected;
• particular AI models will always remain available;
• conversations or other stored data will never be lost.

AI-generated content should not be treated as verified factual information.

Nothing in these Terms excludes warranties or legal rights that cannot be excluded under applicable law.

24. Limitation of Liability

To the maximum extent permitted by applicable law, Eternal+ and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of or inability to use the Service.

This may include losses arising from:

• reliance on AI-generated content;
• interruption of the Service;
• loss of data;
• third-party service failures;
• unauthorized use of your account;
• loss of business opportunities;
• loss of profits.

Where liability cannot legally be excluded, it will be limited only to the extent permitted by applicable law.

Nothing in these Terms limits liability where such limitation is prohibited by law.

25. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses, liabilities, costs, or expenses arising from:

• your unlawful use of Eternal+;
• your violation of these Terms;
• your violation of the Community Guidelines;
• your infringement of another person's rights;
• content you submit in violation of applicable law.

This section applies only to the extent permitted and enforceable under applicable law.

26. Changes to These Terms

We may update these Terms from time to time.

Changes may be made to reflect:

• new product features;
• changes to our services;
• changes in payment or subscription arrangements;
• security requirements;
• changes in applicable law;
• operational changes.

When material changes are made, we may update the “Last updated” date and provide additional notice where appropriate.

Your continued use of Eternal+ after updated Terms become effective may constitute acceptance of the revised Terms where permitted by applicable law.

27. General

These Terms, together with the Privacy Policy and Community Guidelines, form the agreement governing your use of Eternal+.

Entire Agreement

These Terms and any policies incorporated into them constitute the agreement between you and Eternal+ concerning use of the Service, except where additional terms are expressly presented for a particular feature or transaction.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

No Waiver

If we do not immediately enforce a provision of these Terms, that does not mean we waive the right to enforce it later.

Assignment

You may not transfer your rights or obligations under these Terms in a way that would interfere with operation of the Service without our consent.

We may transfer rights or obligations relating to Eternal+ as part of a legitimate transfer, restructuring, or change in operation of the Service, subject to applicable law.

Applicable Law

These Terms and disputes relating to Eternal+ are subject to applicable law, including any mandatory consumer protection rules that may apply.

If a dispute arises, the parties should first attempt to resolve it through good-faith communication.

If a dispute cannot be resolved informally, it may be handled by a court or other competent authority having jurisdiction under applicable law.
